The article examined the essence of criminal- legal conflict, and its role in the differentiation of the form of criminal legal procedure. Activity in the organization of restorative mediation is analyzed, and in this case the author's vision of the strategic tasks of restorative mediation in the criminal cases in Russia is derived.

In the article author’s approach to new restoration ways of reaction to the crime — a decision of criminal-legal dispute by means of conventional (contractual) form of criminal proceedings (the X-th section of RF CLC) and conventional (contractual) form of out-court decision of criminal-legal dispute’s, their historical roots, types and development’s prospects are considered.
